TERMS AND CONDITIONS ON THE NET

The following terms and conditions apply to all purchases of items from this website. Please read this document carefully before placing your order. We reserve the right to change these terms from time to time. Any such changes shall not affect any contract subsisting between us at the time of such change. Please check them before you make any new purchase. We advise you, our valued customer, to print and keep safe a copy of these terms and conditions for your reference.

1. Sale of Goods

1.1. By placing an order with Fortuna Euronics (referred to as us/we/our) you (the customer) are accepting these terms and conditions, as well as our Terms of Website Use, to the exclusion of all other terms and conditions. These conditions do not affect your statutory rights.
1.2. We will acknowledge your order by e-mail as soon as possible. Any e-mail or other acknowledgment from us does not constitute our legal acceptance of your order. Your offer is accepted and our contract begins with you, our valued customer, when the goods are dispatched.
1.3. We will e-mail you a copy of your receipt. Please ensure you keep this in a safe place as this will also be your guarantee on the following terms: Should any of the goods develop a fault simply return your goods within 30 days of purchase (complete with original packaging and accessories – please refer to “6. Returns” for additional conditions that apply) and you will be offered the choice of either an exchange or full refund. Should a fault develop and the goods are returned to us after 30 days, but within the guarantee period, we will provide a free of charge repair as soon as possible, depending on the delivery of the required parts. After the guarantee has expired we will still endeavour to help with any servicing your goods may require.
1.4. All items (excluding wearable parts) are guaranteed for a full 12 months for domestic use (ex demo/ex service goods are guaranteed for 3 months - excluding TV). Obviously we can’t be expected to guarantee against misuse (i.e. coffee spilt inside, blown speakers, leaking batteries, etc.), commercial use, loss of data stored on any form of writeable/ rewriteable media/ hard drive devices, dead pixels of an amount not covered by the manufacturer’s specifications or normal wear and tear. Please note the guarantee will be invalidated if repairs are done other than by us or our authorised agents.
1.5. To secure your guarantee is fully registered with us, please visit www.fortunajersey.com/warranties and fill in the online form with fourteen days of purchase.
1.6. Either of us shall have the right to terminate the contract between us without penalty within seven days from the date we accept your order. In the event of termination we will gladly refund to you all sums paid to us and you shall return any goods that we have dispatched to you at your own expense. Termination of contract shall be without prejudice to the rights and duties of either you or us accrued prior to termination.
1.7. Please be aware that we are obliged to inform TV licensing of all TV purchases as well as a number of other TV related products, including DVD Recorders and Freeview Boxes.

2. Payment and Prices

2.1. We will accept payment of your order by Paypal payments (including Visa, Mastercard, Delta/Connect and Maestro only via Paypal).
2.2. Payment by cheque or cash on delivery is not accepted.
2.3. Unfortunately we do not offer credit facilities online. But credit is available via Retail Store at Halkett Place (Terms and Conditions Apply).
2.4. Payment for goods must be made in accordance with our purchase procedure.
2.5. All orders are positively credit card sanctioned prior to dispatch. We cannot accept responsibility if any details you provide us with are incorrect or if any order is held up as a result of incorrect details.
2.6. The price for the goods will be as stipulated on the website at the time when you place your order.
2.7. We are entitled to make adjustments to the price to take account of any increase in our supplier’s prices, or the imposition of any new taxes or duties, or if due to an error or omission on the price published for the goods on our website is wrong.
2.8. We try to ensure that all prices displayed on our website are accurate, but the price of the goods on your order will need to be validated by us prior to processing your order.
2.9. If there is a problem, we will inform you of the correct price and will give you the opportunity to purchase the goods at the correct price.
2.10. All prices on our website are in pounds sterling and inclusive of GST but exclusive of our very reasonable delivery charges (if applied), which will be payable as indicated at the time of placing your order or thereafter during confirmation of your order.

3. Availability

3.1. Your order for goods is subject to availability.
3.2. If we do not supply goods to you for any reason we will inform you of the situation and will not charge you for those goods, we will obviously refund any money already paid by you for the goods.
3.3. However, we will not be responsible for compensating you for any other losses, which you may suffer if we do not supply the goods.
3.4. All offers 1 per customer / household
3.5. If you have placed a pre-order for an item, you will be advised on an ETA prior we place the order.

4. Collection

4.1. If you have selected the option to collect your goods, the follow will occur:
4.1.1. You will proceed to checkout and make payment.
4.1.2. You will receive an order acknowledgement.
4.1.3. You will be contacted, where you have the choice of collection and arrange a suitable time to collect.
4.1.4. You will receive a confirmation email for collection.
4.2. Normally, collection for same day (Monday – Friday), orders must be placed before 2pm (Excluding holidays).
4.3. Availability for collection on Saturday and some Sundays can be arranged.
4.4. On collection, you must present a valid photographic ID, present your collection confirmation email and sign for the goods.

5. Delivery

5.1. We regret cannot accept orders outside of the UK, Ireland and Channel Islands.
5.2. We regret that we cannot make deliveries to addresses outside of Jersey Channel Islands, although arrangement for courier can be made at additional costs.
5.3. For delivery addresses within the Jersey Channel Islands, we will endeavour to deliver the goods within the times stated in our Purchase Procedure, but time shall not be of the essence.
5.4. If no times are specified, delivery shall be within a reasonable time.
5.5. We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods unless caused by our negligence.
5.6. Should delivery be delayed by us for more than 7 working days from the delivery date you have the right to contact us and refuse the goods.
5.6.1. In this case we will happily refund you any money paid for the goods, as the last thing we want is a dissatisfied customer.
5.7. We reserve the right to charge £35 for re-delivery if you are not present at the agreed original delivery date.
5.8. As soon as we have delivered the goods to you, you will be responsible for them.
5.9. When we deliver the goods we will require you or a nominated person to sign for them.
5.10. If you are not able to sign for a delivery, we will do our utmost to let you know when we intend to redeliver the goods again.
5.11. Our responsibility for everything other than damage due to our negligence will end at the time the carrier tried to delivery the goods to you.
5.12. Title in the goods will pass on delivery.
5.13. Should you return the goods pursuant to conditions set out under these terms and conditions, then title in the goods shall revert to us when you return the goods to us.
5.14. Important Delivery Information
5.14.1. We will contact you by email or phone to arrange a mutually convenient delivery time.
5.14.2. We cannot change the delivery address from that placed at the time of your order.
5.14.3. If an order is placed online with a delivery address that differs from the card registered address we will carry out security checks to protect you from fraud.
5.14.4. If you choose to collect your purchase in person at Fortuna, Halkett Place, please remember to bring the reference on your order confirmation and photographic ID such as passport, driving license or bus pass.
5.15. Appliances Installation 5.15.1. Connection can be carried out to an existing standard domestic appliance water connection situated within one metre of the appliances location and to a suitable existing 13 amp socket within reach of the appliance’s power lead.
5.15.2. Included in the connection will be the removal of transit brackets and a test of the appliance.
5.15.3. The delivery team will be unable to connect your new appliance if:
5.15.3.1. The old machine is not disconnected.
5.15.3.2. Any electrical/plumbing supplies needed fail the delivery team’s testing or are considered unsuitable.
5.15.3.3. Any water supply needed cannot be isolated or is unsuitable.
5.15.3.4. Any drainage/waste facilities needed are unsuitable.
5.15.3.5. Mechanical adjustments are required to the appliance(s) to overcome such things as water pressure problems.
5.15.3.6. Alterations to existing plumbing and electrical wiring are required
5.15.3.7. The appliance requires "Hard Wiring"
5.15.3.8. Alterations are required to existing cupboards and cabinets.
5.15.3.9. The connection is to extended pipe work
5.15.4. We do not install gas appliances or cooker hoods.
5.16. TV Installation
5.16.1. Here’s what we will do
5.16.1.1. Disconnect the existing TV, unpack and check your new TV and stand.
5.16.1.2. Set up your new TV and auto tune the TV to the available channels.
5.16.1.3.If you have bought a stand, we’ll assemble it or install the TV on existing compatible wall brackets (based on the engineers discretion), providing this has been arranged prior Order Confirmation.
5.16.1.4. Connect your TV to other devices such as a Blu-ray player and games console. (Make sure you have the necessary cables: SCART, AVI HDMI etc.)
5.16.1.5. Take away your old TV and packaging for recycling if you’d like us to.
5.16.2. What we don’t do:
5.16.2.1. We won’t install new wall brackets and mount the TV. However, we can organise to do so.
5.16.2.2. We will not setup a network connection to your router. However, we can organise to do so.
5.17. Important Installation Information
5.17.1. We will arrange an installation date with you.
5.17.2. Installation date will be confirmed to you via email.
5.17.3. Your rights to cancellation will end when we start to carry out the contract.

6. Returns

6.1. Goods, other than faulty goods, may be returned within fourteen calendar days of the day after the date of receipt by you of the goods.
6.2. The cost of the return delivery charge under these circumstances is to be paid directly by the customer.
6.3. As you can appreciate, we would request that all goods be returned in an ‘as new’ condition complete with packaging and all accessories.
6.4. Unfortunately, goods which do not comply with this condition may be subject to a handling charge.
6.5. Where goods are returned in accordance with this provision, we will happily reimburse any money already paid by you, excluding any delivery costs incurred by us.
6.6. We will usually refund you what you paid for the goods but not the delivery charges except in cases where the order was cancelled under the Jersey Distance Selling act or the item was faulty.
6.7. More information on the Jersey Distance Selling act can be found here.
6.8. When we receive the returned goods, we will inspect them to ensure all manuals, accessories and other components are within the returned package and that you have taken reasonable care of the goods.
6.9. If we receive an item that you have not taken reasonable care of, we will charge you a reasonable fee as well as a fee equivalent to the reduction in the item’s value.
6.10. If the item has missing components, we shall charge you a further fee to cover the cost of these items. These costs will be deducted from any refund that is due to you. An indication (but not fixed) of the charges (Inc GST) for missing accessories is as follows:-
6.10.1. Charger/Adaptor: £40
6.10.2. Headphones: £20
6.10.3. Instruction manual: £10
6.10.4. Lead: £20
6.10.5. Media card: £45
6.10.6. Memory Stick: £45
6.10.7. Rechargeable battery: £45
6.10.8. Remote Control: £55
6.10.9. Television stands (missing or incomplete) will be charged at the full replacement cost of the stand plus 20% handling fees.

7. Faulty/Damaged Items

7.1. Important notice: time limit for notification of claims:- If goods arrive in a damaged condition you must inform us within 7 days of the date of delivery and we will either replace the goods at no charge, or refund any money paid by you for the goods.
7.1.1. If the goods returned under this condition are found not to be defective and in full working order, they will be returned to you. If the goods are found to be faulty outside 7 days from receipt of goods, please refer to “Sale of Goods” for additional conditions that apply.
7.1.2. Upon delivery, you must sign for the goods and accept the condition of the goods as not damaged. It is your responsibility to inspect the goods, prior signing.
7.2. If we are required to send an engineer to your home to inspect and repair a product, and that product is subsequently found to be in good working order, we will charge you for the costs we incur for the call-out (typically £50.00).
7.2.1. At the time of booking the call, we will ask you to guarantee the cost of the call-out before instructing the engineer by securing a credit or debit card deposit. We will only charge the abortive call-out fee to your debit or credit card if no fault is found.

8. Liability

8.1. Many of the goods we sell are of a technical nature and unfortunately it is not practical to publish detailed specifications of all the goods and keep specifications 100% up to date.
8.2. All drawings, descriptive matter, specifications and advertising on our website are for the sole purpose of giving approximate descriptions of the goods.
8.3. However, if your goods do not conform to the specification displayed on the website relating to such goods at the date of purchase, we will arrange for collection (please refer to 6.10) of the goods from you and you will be entitled to receive a refund on production of the proof of purchase (sale receipt).
8.4. As you can appreciate we shall not be liable to you, for any failure or delay in performance of our contract, if it is due to an event beyond our reasonable control.
8.4.1. Including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.
8.5. The contract between us shall be deemed, to have been made in Jersey Channel Islands and shall be governed by the laws of Bailiwick of Jersey.

9. Complaint Procedure

9.1. We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise.
9.2. We will however endeavour to acknowledge all complaints within 7 working days.
